Overview

Payment Processing

As a member you are responsible for paying membership fees pertaining to the specific billing package purchased. You will be billed utilizing the payment method you select immediately after purchase. All billing is processed by one of the following trusted payment processing and/or ecommerce platforms, Argus/Mayflower, CCBill, Epoch, or Segpay.

It is important that you keep the welcome email you receive from your payment processing company after you join.

It is each member’s sole responsibility to inform us of any changes in the method of payment or changes in credit card details once their card has expired for continuation of service.

Billing and Cancellations

All membership packages will automatically renew upon expiration unless your subscription is canceled prior to the end of the current subscription package term, or unless you select a non-recurring type of membership, such as a 90-day non-recurring membership plan.

Membership cancellations will not be accepted via email. Membership cancellations must be canceled by contacting the payment processing company that appears on your credit card or bank account statement. You can contact your payment processing company by utilizing one of the links on our cancellation page

Refund Policy

Any refunds requests will be handled on a case-by-case basis by the payment processing company that services your account.

Chargebacks And Fraud

In the event a customer requests a charge back, our processors will investigate the transaction. False chargebacks may land you on a blacklist with your payment processor, which could complicate future memberships or authorizations by said processor. Please contact us for a resolution before filing a chargeback.

Content/Material Removal or Modification

The Works/Titles made available on our Websites are subject to change at any time without notice. We reserve the right to modify, edit, or remove specific audio-visual Works or specific performers from our Websites at any time and for any reason in our sole discretion. There is no guarantee that any specific Titles or performers will remain available on our Websites, and any modification, editing, removal or other change in or to the Titles or performers on our Websites does not entitle you to a refund.

General Terms

You agree to the following:

1. Age Verification – Recent statutory and regulatory changes enacted by multiple states, now require us to verify the age of users accessing our websites. If you reside in one of the areas affected by these changes, you will be required to provide us with the legally mandated information needed to verify you are of legal age to access our Websites. Please note that we utilize the services of an independent third-party age verification vendor to process all required age verification submissions. Failure to fully and accurately complete the age verification process will result in either denial of access to our Websites or restricted access to certain features or content depending on the legal requirements in the area you reside. We are committed to protecting user privacy during this process and will handle any verification information in accordance with our Privacy Policy and applicable data protection laws.
2. Usernames and Passwords – A member’s username and password is not transferable and is not to be distributed to others. We monitor memberships, usernames and passwords and distribution and transfer of said information will result in immediate suspension of service and possible further legal action. Under law we must hold the member liable for unauthorized breach of membership.
3. Violation of Terms of Service – We reserve the right to block usernames, IP addresses, and entire geographic locations for any violations of the Terms of Service, for security reasons, and for any other reason we feel appropriate. See REFUND POLICY above for more information.
4. Content Throttling – We reserve the right to limit the amount of content a member can download per day.
5. Bonus Sites/Third-Party Sites – In our sole discretion, we may offer members access to other websites operated by us or third parties (“Bonus Sites”). Each member understands and agrees that we may remove or limit access to Bonus Sites at any time for any reason.
   
   We may offer services from third party providers. Unless specifically stated to be “free” or “no cost”, you should assume that such third-party services are not free and that charges will be assessed. Any such charges are the member’s responsibility.
   
   We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any Bonus Sites or third-party websites. Please carefully review each third-party’s policies and practices and make sure you understand them before you engage in any transaction.
   
   For each Bonus Sites operated by third parties, each member agrees not to contact the webmaster or operators of the Bonus Site to which the member has been given access but instead will contact our support team directly with any questions or concerns. We will then forward such questions or concerns to the appropriate webmaster or operator at his or her discretion.
   
   Each member understands that we, and any operator(s) of a Bonus Site to which member has been given access, reserve the right to block or otherwise deny access to such sites, block usernames or IP addresses, and take any other measures deemed fit. For example, if a member violates terms of use of a Bonus Site, we or the operator of such Bonus Site may block that member from accessing the Bonus Site’s members’ area and/or the members’ area of our Websites.
6. Prohibited Uses – In addition to any other prohibitions as set forth in these Terms of Service, you are prohibited from using the Websites and/or Materials: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Websites, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Websites, other websites, or the Internet. We reserve the right to terminate your use and access to the Materials, Websites, or any related website for engaging in any of the aforesaid prohibited uses.
7. Equipment – It is the sole responsibility of each member to acquire all equipment (hardware and software) necessary to access, navigate, and view the Materials on the Websites. We assume no responsibility or obligation in that regard.
8. Right of Cancellation – We reserve the right to cancel or refuse membership to any individual or entity at any time for any reason. We reserve the right to deny membership or access to visitors from certain countries or locales for any reason.
9. Disclaimer of Warranties; Limitation of Liability and Damages – We do not guarantee, represent or warrant that your use of our Websites and/or the Materials  will be uninterrupted, timely, secure or error-free. You agree that from time-to-time we may remove the Websites and/or Materials for indefinite periods of time or cancel same without notice to you. You expressly agree that your use of, or inability to use, the Websites is at your sole risk. The Websites and  all content, products and services delivered to you through the Websites are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
   
   In no case shall The Mayflower Group LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Websites and/or Materials, or any other service, third-party service, or products procured using the Websites, or for any other claim related in any way to your use of the Websites and/or Materials, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Websites or any content posted, transmitted, or otherwise made available via the Websites, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. In the event of litigation between you and us, your damages shall be limited to the amount paid to us by you during the most recent 6-month period.
10. Indemnification – You agree to indemnify, defend and hold harmless The Mayflower Group LLC and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or rights of a third-party.
11. Intellectual Property/Restrictions on Use – The Materials, including but not limited to, all audio-visual works, still images, sounds, text, and any and all other material maintained on each of the Websites is the sole or licensed property of The Mayflower Group LLC, and each member acknowledges and agrees not to copy disseminate, sell, and/or otherwise distribute such Materials without our express written consent.

13. Severability – In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
14. Entire Agreement – The failure by us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
    
    These Terms of Service and any policies or operating rules posted by us on this site or with respect to the Websites and/or Materials constitutes the entire agreement and understanding between you and us and govern your use of the Websites and/or Materials, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
15. Governing Law/Jurisdiction – Each member consents, acknowledges and agrees that these Terms and any dispute concerning or arising from such Terms shall be governed by the laws of the State of Arizona and/or the federal law of the United States of America.  Each member consents, acknowledges and agrees that any lawsuit commenced by a member shall be venued in a court of competent jurisdiction located in Maricopa County, Arizona.
